Terms of Use – Water Activities

1. Booking & Payment
To secure your place on any of our water activities, a 30% deposit per person is required at the time of booking. The balance can be paid directly on board on the day of the activity.
We accept the following payment methods:
• Credit and debit cards (Visa, Mastercard)
• Cash (EUR only)
Upon successful booking, you will receive a confirmation email with all relevant details. Please ensure you provide accurate contact information to avoid missed communications.
2. Cancellation & Refund Policy
• Full refunds are available for cancellations made at least 48 hours before the scheduled departure time.
• Cancellations made less than 48 hours in advance will incur a 50% cancellation fee of the total booking amount.
• No-shows or same-day cancellations are not eligible for any refund.
• In the event of unsafe weather, technical issues, or unforeseen operational reasons, Santa Maria Water Sports reserves the right to cancel or reschedule your activity. In such cases, you will be offered either a full refund or the option to rebook on an alternative date.

3. Age, Health & Safety Requirements
• Minimum age: 6 years old
• All participants must be able to swim unaided and be in good physical condition
• Life vests and safety gear will be provided and must be worn at all times
• Alcohol and recreational drugs are strictly prohibited before and during the activity
• Our captain and crew reserve the right to deny boarding or terminate an activity if a participant is deemed unfit or behaves in a way that endangers themselves or others
4. Responsibility & Insurance
• While we take every precaution to ensure your safety, participation in water sports and boating activities involves inherent risks. By booking with us, you acknowledge and accept these risks.
• Santa Maria Water Sports Ltd is fully insured with public liability coverage.
• We strongly recommend that all guests have personal travel insurance that covers water sports and medical expenses.
• The company is not responsible for loss or damage to personal belongings brought onboard.
• By confirming your booking, you agree to waive liability against Santa Maria Water Sports Ltd, its staff and partners, for any injury or incident that occurs due to personal negligence or failure to follow instructions.
5. Delays & Exceptional Circumstances
We make every effort to operate according to schedule. However, we are not liable for delays caused by:
• Weather conditions
• Mechanical issues
• Government restrictions
• Acts of nature or other events beyond our control
In such cases, we will do our best to communicate promptly and provide suitable alternatives.
6. Code of Conduct Onboard
We aim to provide a safe, fun, and respectful environment for all guests. We kindly ask that you:
• Follow all instructions from the captain and crew
• Respect the boat, equipment, and fellow guests
• Avoid excessive noise or disruptive behavior
We reserve the right to terminate the trip without refund if any passenger violates our code of conduct or endangers the safety of the experience.
